Legality Protocol

During the construction of the infrastructure-system, Tangenziale Esterna not only strictly complied with ordinary laws, but also scrupulously observed the agreements and commitments made with the Prefecture and trade associations described in the Legality Protocol against the infiltration of organised crime in the management of tenders related to the works included in the Expo Dossier.

The Legality Protocol was signed by the Concessionaire and the Consorzio Costruttori TEEM on 31 July 2012 at the Prefecture of Milan. It did so according to the guidelines adopted by the Coordination Committee for the High Supervision of Major Works and published in the “Official Gazette of the Italian Republic”. For the A58-TEEM, the signatories of the Legality Protocol were:

  • Prefecture of Milan
  • Prefecture of Lodi
  • Prefecture of Monza and Brianza
  • Concessioni Autostradali Lombarde S.p.A.
  • Tangenziale Esterna S.p.A.
  • Consorzio Costruttori TEEM

 

All signatories of the Legality Protocol in relation to the construction of TEEM sought to ensure, during all construction phases, compliance with the regulations in force, transparency and free competition by fully exercising the monitoring and supervisory powers attributed by the Law, also for the purpose of preventing, controlling and opposing attempts of infiltration of organised crime in the management of contracts. The other primary objective of the Legality Protocol was the constant verification of safety conditions in the workplace as well as the fight against the phenomenon of “undeclared employment”.

In order to apply the dictates of the Legality Protocol in daily life, Tangenziale Esterna acquires, prior to the stipulation, approval and authorisation of each contractual instrument envisaged, the anti-mafia information and, if there are attempts or elements of infiltration against the companies, does not proceed with the stipulation, approval or authorisation of contracts or sub-contracts. In order to put the provisions of the Legality Protocol into practice, TE has set up and made operational a database, called “Genesis”, the result of considerable investment of economic and human resources in the use of the most modern technologies available, which makes it possible to constantly monitor all the companies involved in the construction of the A58-TEEM and to cross-reference the anti-mafia information with the computer systems of the competent Prefectures, the Interforce Group, Concessioni Autostradali Lombarde and the Works Management. To this end, Tangenziale Esterna has included within “Genesis” a weekly report called “Worksite Weekly”, which contains every useful and detailed indication of the works to be carried out with the company name and the names of all the employees who, during the week in question, are engaged in the works as well as any other person authorised to access the worksites.

Again with the aim of countering the possible infiltration of organised crime in the construction cycle of the work, a special “Labour Monitoring Board” was set up at the Prefecture of Milan, in which the granting body CAL and the Territorial Directorate of Labour also took part. It was, therefore, a team effort that made it possible to constantly keep the entire construction phase under control in order to prevent any anomalies in the correct application of the strictest procedures for the assignment of works and the stipulation of contracts, tenders, subcontracts and supply agreements. Monitoring is, of course, extended to all implementation phases.
